In consideration of the acceptance of my entry for the Head of the Oakland Estuary Regatta, I hereby waive, release and discharge any and all claims for damages for death, personal injury and property damage which I may have, or which may hereafter accrue to me, as a result of my participation in the said Regatta. If my child or ward is 17 years of age or younger, I hereby waive, release and discharge, on my own behalf, and on behalf of my child or ward, any and all claims for damages for death, personal injury and property damage which I or my child or ward may have, or which may hereafter accrue to me or my child or ward, as a result of my child's or ward's participation in the said Regatta.

This release is intended to discharge in advance the individual Regatta volunteer workers, the Regatta promoters and sponsors, the Lake Merritt Rowing Club, Inc., the City of Oakland, including without limitation the Port of Oakland and the Oakland Office of Parks, Recreation and Cultural Affairs, Oakland Portside Associates, the United States Rowing Association, the officials and any involved municipalities or other public entities, and their respective agents and employees, from and against any and all liability arising out of or in connection in any way with my participation in said Regatta, even though that liability may arise out of negligence or carelessness on the part of the persons or entities mentioned above.

It is understood that serious accidents occasionally occur during on-water rowing activities and related on-shore activities, and that participants thereof occasionally sustain mortal or serious personal injuries and/or property damage as a consequence thereof. Knowing the risks of participation, nevertheless, it is hereby agreed that those risks and are assumed and that all of the persons and entities mentioned above who, through negligence and carelessness might otherwise be liable for damages, are released and held harmless therefrom. It is further understood and agreed that this waiver, release and assumption of risk is to be binding on my heirs and assigns, and the heirs and assigns of my child or ward.
