In consideration of the acceptance of my entry for the Head of the Oakland Estuary rowing regatta (Athe Regatta@), I hereby waive, release and discharge any and all claims for damages for death, personal injury or property damages that I may have, or that may hereafter accrue to me, as a result of my participation in the Regatta. If my child or ward is 17 years of age or younger, I hereby waive, release and discharge, on my own behalf and on behalf of my child or ward, any and all claims for damages for death, personal injury or property damages that I or my child or ward may have, or that may hereafter accrue to me or my child or ward, as a result of my child=s or ward=s participation in the Regatta. This release is intended to discharge in advance the individual Regatta volunteer workers, the Regatta promoters and sponsors, the Lake Merritt Rowing Club, Inc., the Oakland Strokes, Inc., the City of Oakland, the Port of Oakland, Oakland Portside Associates, the United States Rowing Association, and their respective agents and employees, from and against any and all liability arising out of or in connection with the Regatta, even though that liability may arise out of the negligence or carelessness on the part of the persons or entities listed above. it is understood that serious accidents occasionally occur during on-water rowing activities and related on-land activities, and that participants thereof occasionally sustain serious or mortal personal injuries and/or property damage as a consequence thereof. Knowing the risks of such participation, it is hereby understood that such risks are assumed and that all of the persons or entities mentioned above are released and held harmless therefrom. This waiver and release of liability and assumption of risk is binding upon my heirs and assigns and upon the heirs and assigns of my child or ward.
